The "Top Gun" actor was spotted flying in a private helicopter as he sat on the passenger side with his signature aviators covering the star's face at times.
The sighting of one of Hollywood's most high profile actors comes just after a recent report from TMZ claimimg Tom's soon-to-be ex wife Katie Holmes is concerned that she is being followed by the couple's odd religious group Scientology .
According to sources close to the "Dawson's Creek" starlet, she believes is being followed and watched and various paparrazi who have been photographing Katie think it may be true.
The report points out that a white Cadillac Escalade and a black Mercedes SUV have been seen multiple times hanging around Holmes and Cruise's NYC apartment as well as following the actress when she goes out.
It has not been confirmed at this time if the mystery vehicles are that of members of the Scientology church, but if the allegations are true it could help her get sole custody of the couple's six year old daughter Suri.
As previously reported by GossipCenter, Holmes filed for divorce in New York City on June 28 citing the common, irreconcilable differences.
The brunette beauty is seeking primary residential custody of Suri while Cruise's spokesperson told press, "Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children. Please allow them their privacy to work this out.”
